SMS/TEXT MESSAGE TERMS AND CONDITIONS

1. INTRODUCTION AND AGREEMENT TO TERMS

These SMS/Text Message Terms and Conditions ("SMS Terms") govern your use of AYBL's mobile text messaging service (the "SMS Service"). The SMS Service is operated by RK BRANDS LTD (Company No. 11272653), trading as AYBL ("AYBL", "we", "us", or "our").

BY SUBSCRIBING TO OUR SMS SERVICE, YOU AGREE TO THESE SMS TERMS.

Your use of the SMS Service constitutes your acceptance of these SMS Terms. If you do not agree to these SMS Terms, you must not subscribe to or use the SMS Service.

These SMS Terms are part of and incorporated into our main Terms and Conditions and Privacy Policy. In the event of any conflict, these SMS Terms shall govern with respect to the SMS Service.

3. SMS SERVICE DESCRIPTION

3.1 What the SMS Service Includes

By subscribing to our SMS Service, you consent to receive recurring text messages (SMS/MMS) from and on behalf of AYBL to the mobile telephone number you provided during subscription.

The SMS Service may include the following types of messages:

Transactional Messages:

• Order confirmations

• Shipping and delivery notifications

• Order status updates

• Delivery alerts and tracking information

• Return and refund confirmations

• Account notifications and security alerts

• Customer service responses

Promotional Messages:

• Special offers and discounts

• New product announcements

• Sales and promotional events

• Exclusive subscriber benefits

• Cart abandonment reminders

• Back-in-stock notifications

• Marketing and promotional content

3.2 Message Frequency

Message frequency varies based on your activity and subscription preferences. You may receive:

• Transactional messages: As needed based on your orders and account activity

• Promotional messages: Up to 4-8 messages per month (may vary during special events or sales)

We reserve the right to adjust message frequency at our discretion, though we will always strive to provide a valuable and non-intrusive experience.

3.3 Technology Used

Text messages may be sent using an automatic telephone dialing system (ATDS) or other automated technology. Messages will be sent through your wireless provider to the mobile number you provided.

4. CONSENT AND OPT-IN REQUIREMENTS

4.1 Express Consent

By providing your mobile telephone number and subscribing to the SMS Service, you expressly consent to receive text messages from AYBL, even if your mobile number is registered on any national, state, or corporate Do Not Call list or registry.

Your consent is voluntary and is not a condition of any purchase or use of AYBL's products or services. You can make purchases and use our services without subscribing to the SMS Service.

4.2 How to Subscribe

You may subscribe to the SMS Service by:

• Entering your mobile number during checkout

• Providing your mobile number on our website or mobile app

• Texting a keyword (e.g., "JOIN" or "START") to our designated short code or phone number

• Opting in through promotional materials or in-store signage

Upon subscription, you will receive a confirmation message welcoming you to the SMS Service.

4.3 Eligibility

To subscribe to the SMS Service, you must:

• Be at least 16 years of age (or 18 in certain jurisdictions)

• Be the authorized user or account holder of the mobile number provided

• Have authorization to incur charges on the mobile account

• Provide a valid mobile telephone number

5. COSTS AND CHARGES

5.1 No Charge from AYBL

AYBL does not charge any fees for the SMS Service. The service is provided free of charge to subscribers.

5.2 Carrier Charges

Message and data rates may apply.

You are responsible for all charges and fees associated with text messaging imposed by your wireless service provider. These charges may include:

• Standard text messaging rates

• Data usage charges (for MMS messages with images)

• International messaging fees (if applicable)

• Roaming charges (if traveling)

The number of messages you receive may vary, and charges may accumulate accordingly. Please check your mobile plan and contact your wireless provider for details about your messaging and data plan rates.

You are solely responsible for all charges related to SMS/text messages.

6. OPTING OUT AND UNSUBSCRIBING

6.1 Your Right to Opt Out

You may opt out of the SMS Service at any time. Opting out is free and will take effect for future messages (messages already sent or in transit may still be delivered).

6.2 How to Opt Out

To unsubscribe from the SMS Service, you may:

Option 1: Text "STOP"

Reply with the keyword "STOP", "END", "CANCEL", "UNSUBSCRIBE", or "QUIT" to any message you receive from us. You will receive a one-time confirmation message confirming your opt-out.

Option 2: Click Unsubscribe Link

Click the unsubscribe link included in applicable text messages (where available).

Option 3: Update Account Preferences

Log into your AYBL account and update your SMS preferences in your account settings.

Option 4: Contact Customer Service

Email us at support@aybl.com with "SMS Unsubscribe" in the subject line and include your mobile number.

6.3 Effect of Opting Out

After opting out:

• You will no longer receive promotional or marketing messages

• You may still receive critical transactional messages related to your orders

• You can re-subscribe at any time by following the subscription process

Note: If you have subscribed to multiple AYBL messaging programs (e.g., different brands or regions), you may need to opt out separately from each program.

8. SUPPORTED CARRIERS AND COMPATIBILITY

8.1 Compatible Carriers

The SMS Service is available to subscribers with compatible mobile devices and supported wireless carriers, including but not limited to:

• EE

• O2

• Vodafone

• Three

• Virgin Mobile

• Tesco Mobile

• GiffGaff

• Other major UK carriers and MVNOs

Carrier coverage and compatibility may vary by location and service. Not all mobile devices or carriers may support all features of the SMS Service.

8.2 Carrier Disclaimer

Wireless carriers are not liable for delayed, failed, or undelivered messages. Issues with message delivery should be directed to your wireless carrier or to AYBL customer support.

9. USER RESPONSIBILITIES

9.1 Accurate Information

You agree to:

• Provide a valid, working mobile telephone number

• Update your mobile number if it changes

• Ensure you have authorization to use the mobile number provided

• Notify us promptly if you are no longer the owner or authorized user of the number

9.2 New Mobile Number

If you change your mobile number, you must:

• Opt out from your old number

• Re-subscribe using your new mobile number

• Update your contact information in your AYBL account

We are not responsible for messages sent to an outdated or incorrect mobile number.

9.3 Prohibited Uses

You may not use the SMS Service to:

• Send spam or unsolicited messages

• Transmit viruses, malware, or harmful code

• Harass, abuse, or threaten others

• Engage in fraudulent or illegal activity

• Violate any applicable laws or regulations

10. CHANGES TO THE SMS SERVICE

10.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the SMS Service (or any part thereof) at any time, with or without notice, for any reason including:

• Technical requirements or improvements

• Changes in legal or regulatory requirements

• Business reasons or operational changes

• Security concerns

10.2 Short Code and Number Changes

We may change any short code or telephone number used to operate the SMS Service at any time. When we make such changes, we will notify you via text message or other reasonable means.

You acknowledge that messages sent to an old or changed number (including STOP or HELP requests) may not be received, and we will not be responsible for honoring requests made to discontinued numbers.

11. PRIVACY AND DATA PROTECTION

11.1 Information We Collect

When you subscribe to the SMS Service, we collect:

• Your mobile telephone number

• Subscription date and preferences

• Message delivery and engagement data

• Information about your mobile carrier

• Any information you provide in reply messages

12. DISCLAIMERS AND LIMITATIONS OF LIABILITY

The SMS Service is provided "as is" and "as available." We do not guarantee that:

• Messages will be delivered on time or at all

• The service will be uninterrupted or error-free

• Messages will be received in the order sent

• All features will be compatible with all devices and carriers

12.2 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for failed, delayed, or misdirected message delivery

• We are not liable for errors in messages or service interruptions

• We are not liable for actions you take (or fail to take) in reliance on messages

• We are not liable for charges imposed by your wireless carrier

• We are not responsible for the actions or omissions of wireless carriers

12.3 Third-Party Services

We use third-party service providers to deliver the SMS Service. While we work with reputable providers, we cannot control their systems or guarantee their performance. We are not responsible for any failures or issues caused by third-party service providers.

13. LEGAL COMPLIANCE AND REGULATIONS

13.1 Regulatory Compliance

The SMS Service complies with applicable laws and regulations, including:

• UK Privacy and Electronic Communications Regulations (PECR)

• UK General Data Protection Regulation (UK GDPR)

• EU General Data Protection Regulation (GDPR) where applicable

• Telephone Consumer Protection Act (TCPA) for US subscribers

13.2 Do Not Call Registries

14. CHANGES TO THESE SMS TERMS

These SMS Terms, together with our Privacy Policy and main Terms and Conditions, constitute the entire agreement between you and AYBL regarding the SMS Service.

17.2 Severability

If any provision of these SMS Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these SMS Terms shall not constitute a waiver of that right or provision.

17.4 Assignment

We may assign or transfer these SMS Terms and our rights and obligations at any time without notice. You may not assign these SMS Terms without our prior written consent.
